By accessing or using the Whetstone training platform, including whetstone.health and any of its training modules ("Service"), operated by Whetstone Healthcare Consulting LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
Whetstone is an AI-powered clinical communication training platform. The Service is delivered as a suite of training modules — including Motivational Interviewing (MIRROR), Hard Medical Conversations, Cognitive Behavioral Therapy (CBT), Dialectical Behavior Therapy (DBT), and Eye Movement Desensitization & Reprocessing (EMDR) — each with simulated patient interactions, skill exercises, transcript analysis, and module-specific scoring rubrics (BEACON, CAIRN, THINK, BALANCE, PRISM).
The Service is intended solely for educational and professional development. It does not provide medical advice, diagnosis, or treatment. Simulated patient interactions are fictional and must not be used as a substitute for clinical judgment or real patient care. AI-generated feedback and scores are training tools and do not constitute clinical certification or competency assessment unless obtained through an approved continuing education pathway.
You must create an account to use the Service. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to use the Service.
Most modules require a paid subscription, billed monthly or annually as selected at checkout, processed securely through Stripe. Access can also be granted via institutional licenses, classroom invite codes redeemed inside a module, or trial codes issued by Whetstone. You may cancel your subscription at any time through Account Settings → Manage Billing; access continues through the end of the current billing period. Refunds are handled case-by-case — contact [email protected].
Promotional codes, classroom invite codes, and coupons are subject to their stated terms, including expiration dates and usage limits. We reserve the right to modify or discontinue promotions at any time. Codes cannot be combined unless explicitly stated.
Whetstone has two categories of features with different rules for handling Protected Health Information (PHI). PHI includes, but is not limited to: patient names, dates of birth, medical record numbers, Social Security numbers, addresses, phone numbers, email addresses, health plan beneficiary numbers, device identifiers, photographs, or any other information that could reasonably be used to identify a specific patient, as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations.
Practice and training features — role-play simulations, exercises, and skill drills — are educational tools intended for use with fictional or fully de-identified scenarios. Do not enter PHI into practice features. When practicing, use invented patients or content de-identified under the HIPAA Safe Harbor method (45 CFR § 164.514(b)(2)) or the Expert Determination method (45 CFR § 164.514(b)(1)).
The Encounter Analyzer and clinical integrations — including the Whetstone extension for Dragon Copilot — are designed to process real clinical encounter content, which may contain PHI. This content is processed and stored on HIPAA-eligible Microsoft Azure infrastructure located in the United States, under Microsoft's Business Associate Agreement, with HIPAA-aligned safeguards including encryption in transit and at rest, access controls, row-level data isolation, and automated de-identification applied to submitted text. Whetstone Healthcare Consulting LLC enters into a Business Associate Agreement with institutional customers as part of the enterprise agreement.
By creating an account and using the Service, you acknowledge and agree that: (a) practice and training features are not intended for PHI, and you are responsible for de-identifying any real content before entering it into those features; (b) the Encounter Analyzer and clinical integrations may be used with real clinical encounter content under the safeguards described above and, for institutional customers, under a Business Associate Agreement; (c) you remain responsible for using each feature in accordance with your organization's policies and your own obligations as a covered entity or business associate under HIPAA; (d) AI-generated feedback is a communication-skills aid, not a certified clinical assessment. If you have not entered into a Business Associate Agreement with us and are unsure whether your use is covered, de-identify content before submission or use fictional scenarios.
You agree not to: (a) share your account credentials with others; (b) attempt to reverse-engineer, copy, scrape, or redistribute the Service or its AI models, scoring rubrics, or curriculum content; (c) use the Service for any unlawful purpose; (d) submit real patient data or PHI (see Section 7); (e) misrepresent AI-generated feedback as certified clinical assessment; (f) use automated tools to interact with the Service in a way that interferes with other users.
All content, design, code, AI prompts, scoring systems (including BEACON, CAIRN, THINK, BALANCE, PRISM), curriculum modules, and educational materials are the intellectual property of Whetstone Healthcare Consulting LLC. Your subscription grants you a personal, non-transferable license to use the Service. You retain ownership of any transcript text or content you submit for analysis.
The Service uses artificial intelligence to generate simulated patient responses, feedback, and scores. AI outputs may occasionally be inaccurate, inconsistent, or biased. You are responsible for applying your own clinical judgment in interpreting any feedback the Service produces.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.
Your practice session data, scores, transcripts, and progress are stored to provide the Service and are associated with your account. You may permanently delete your account and associated data at any time through Account Settings → Delete Account, or by contacting [email protected].
The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total cumulative liability is limited to the amount you paid for the Service in the twelve months preceding any claim.
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes constitutes acceptance.
We reserve the right to suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, and dispute resolution survive termination.
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the State of Washington.
